Here you will find the sales contract regarding the use of the services of Gamuun Dhijitaal, and it applies to the companies we provide these services to.
BOTH PARTIES
The company “Gamuun Dhijitaal” located in Mogadishu, Somalia will be referred to only by its name which is “GAMUUN DHIJITAAL”, and the person or companies we provide services to will be referred to as “SERVER”, and this is the contract between the two parties.
SUBJECT OF THE CONTRACT
b. The companies receiving the services will use these services for a period of one year, and it will be signed by the company receiving our services. b. The email address written on the signature letter will be considered the notification email. c. This contract consists of 8 main points.
This contract, defines the relationship between GAMUUN DHIJITAAL and the USER during the period of the services.
CONTRACT TERM
This contract, begins from the time the USER fills out and signs the application form for the service of GAMUUN DHIJITAAL, and will only be performed for the services chosen by the USER, and will last for a period of 1 year. After 1 year, if the USER requests to continue with the services we have provided, it is mandatory to sign a new application form.
FEES AND PAYMENT
Regarding the services chosen by the USER, the fees for the services are stated in the application form and signature. Starting from the time you receive the service, the fee is guaranteed not to change for 3 years. “For three years, the fees will not change”.
Cancellation Policy;
Once the USER has purchased a service and paid the fee and signed the “SEO, Meta ads, Google Ads, Logo design, Content design & Content placement” service agreement, those services cannot be canceled. If the USER cancels the Website Service, for a period of less than 1 year, based on the day and month of cancellation of that service, GAMUUN DHIJITAAL will decide whether to refund the fee paid by the USER.
SERVICES
a) GAMUUN DHIJITAAL makes it easy for you to obtain 1 (one) domain. That domain cannot be transferred, sold to another person, or rented. It will not be used by another person. b) The USER, when receiving the website building service, is deemed to have accepted the GAMUUN DHIJITAAL hosting system. c) If the USER does not receive services related to the design and construction of the website, the USER is obliged to upload the website (data, images, and products) upon completion of the website. d) At GAMUUN DHIJITAAL, users can contact us by phone during weekdays, while on weekends they will contact us by email. e) When the USER exceeds the allocated network space and traffic limit, they will pay a higher fee to obtain a new traffic limit. f) If the user receives additional services, the previous work will be changed within 24-36 hours.
RIGHTS AND RESPONSIBILITIES OF THE PARTIES
a) The USER has the right to use his website during the contract period. Selling, transferring and renting the website is not allowed. b) The USER may not submit anything to his website that is contrary to the license granted. The USER is responsible for everything that will be submitted to the website, the USER agrees that he will not violate the law of the country or the Republic of Somalia. GAMUUN DHIJITAAL will not accept any liability. c) GAMUUN DHIJITAAL will assist the USER with any problems that arise from the website or social media during the contract period. d) If the USER requests to transfer his website, GAMUUN DHIJITAAL will review that request, and it has the right to implement it or not. e) The website will only be used on the hosting that GAMUUN DHIJITAAL accepts, the USER cannot request that another hosting enter the process or submit anything to the website. f) GAMUUN DIJITAAL only provides the keys to access the hosting, it will not provide anything more. j) The USER will not use the emails created for him for anything wrong or send spam. h) GAMUUN DIJITAAL, if it finds that the emails have been used for spam or anything bad, has the right to close those emails. If the USER wants to reopen those emails, he must pay a fee to reopen that service. i) The USER cannot link the wrong code to his website.
TERMINATION OF THE CONTRACT
a) The USER, upon the expiration of the contract period, if he does not want to renew the contract, will not renew his website. The contract will be terminated. b) If GAMUUN DHIJITAAL finds anything against the contract or the operation of the website, social media, etc., it has the right to terminate the contract without consulting anyone. If the contract is terminated, the USER will not be refunded any fees he has already paid. c) GAMUUN DHIJITAAL will serve the USER for 1 year, which is the contract period, and will give the USER 1 month’s notice when the contract period is remaining. The USER will also be notified whether he will continue to receive the services or terminate the contract. d) If the USER does not submit any request or response to GAMUUN DHIJITAAL, the USER will not submit any (compensation, damages) to GAMUUN DHIJITAAL. In the event that the domain names included in the services are not renewed due to non-payment, the USER will not make any claim (compensation, damages) etc.
Without completing the first year of Hosting that we provide, the first year fee paid and the USER will not be refunded will be given his Panel and keys.
PENALTY
in the event of any dispute that may arise under the terms of the contract, both parties agree that the courts of the country will have the right to decide what is right.
This contract comes into force upon the commencement of the provision of services
